ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING; NO CHANGE IN JUDGMENT

ARONSON, J.

Appellant's petition for rehearing is DENIED.

It is ordered that the opinion filed herein on February 28, 2006 (137 Cal.App.4th 204; _ Cal.Rtpr.3d_), be modified as follows:

1. On page 5 [137 Cal.App.4th 133], delete footnote 6 and renumber subsequent footnotes accordingly.

2. On page 16 [137 Cal.App.4th 142], delete the entire second full paragraph beginning with “Sheryl’s argument fails . . . .”

3. On page 18 [137 Cal.App.4th 143], delete the portion of the first full paragraph beginning with “Sheryl has misconstrued . . .” and ending with “prima facie case of abandonment” and combine the first and second paragraphs, so the new paragraph begins with “As noted above . . .” and ends with “incentives for the disruption of this process.”

4. On page 19, first sentence of the first full paragraph, replace “Brittany H., supra, 198 Cal.App.3d 533” with “In re Brittany H. (1988) 198 Cal.App.3d 533 [243 Cal.Rptr. 763]."

5. On page 19 [137 Cal.App.4th 144], add the following sentence at the end of footnote 10 (renumbered footnote 9): “Nothing in our opinion should be read to suggest abandonment cannot occur during the period a child has been placed for independent adoption.”

The modification does not change the judgment.
