MEMORANDUM OPINION


Relator contends the trial court erred in granting the real party's motion to enforce Rule 11 agreement. Based on the record before us, relator has failed to demonstrate that he is in danger of permanently losing his substantial rights and, therefore, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus.

Moseley, J. dissents and would request a response.
