CONSENT ORDER


This matter having come before the Court by way of an informal joint telephonic application by Andrew P. Napolitano, Esq., Sills Cummis Radin Tischman Epstein Gross, attorneys for Benzel-Busch Motor Car Corp., nominal lead counsel for the defendant dealers, and Steven M. Edwards, Esq., Hogan Hartson, L.L.P., counsel for Mercedes-Benz Manhattan, and it appearing that no defense counsel are likely to object, and for good cause shown;

It is on this 3rd day of March 2001 ORDERED that Steven M. Edwards, from and after this date, shall no longer be a member of the defendant dealers lead counsel committee; and it is

FURTHER ORDERED that Steven M. Edwards or his colleague James A. Moss may serve as a stand alone lead counsel for their client, Mercedes-Benz Manhattan; and it is

FURTHER ORDERED that Mercedes-Benz Manhattan may file in its own behalf a motion to dismiss the plaintiffs' complaint supported by a memorandum of law not in excess of ten pages; and it is

FURTHER ORDERED that the change of status of Mercedes-Benz Manhattan from membership on the defendant dealers lead counsel committee to a stand alone defendant shall have no substantive or scheduling impact on this case.
