Order to show cause issued, returnable in Superior Court

The Secretary of the Department of Corrections and Rehabilitation is ordered to show cause returnable before the Los Angeles County Superior Court, when the matter is placed on calendar, why the eight-year sentence for kidnapping should not be stayed pursuant to Penal Code section 654. (See People v. Latimer (1993) 5 Cal.4th 1203, 1216-1217; People v. Ramirez (1987) 189 Cal.App.3d 603, 615–617; In re Harris (1993) 5 Cal.4th 813, 838–840, 842; People v. Scott (1995) 9 Cal.4th 331, 354, fn. 17.) The return is to be filed on or before December 21, 2017.
