MEMORANDUM OPINION

The underlying case is The State of Texas v. Ellis McMillon, JR. TDCJ # 1503130, No. 1151280 in the 230th Judicial District Court of Harris County, Texas, the Hon. Belinda Hill, presiding.


By petition for writ of mandamus, relator, Ellis McMillon, JR., challenges the trial court's failure to rule on his motion for judgment nunc pro tunc. The trial court has granted McMillon's motion. We dismiss the petition for writ of mandamus as moot.
