IN RE STEPHEN MCCARTY, Relator

ORIGINAL PROCEEDING WRIT OF MANDAMUS
505th District Court Fort Bend County, Texas
Trial Court Cause No. 16-DCV-237771

MEMORANDUM OPINION

On Tuesday, April 28, 2020, relator Stephen McCarty filed a petition for writ of mandamus in this Court. See Tex. Gov't Code § 22.221; see also Tex. R. App. P. 52. Relator asks this court to compel the Honorable David Perwin, presiding judge of the 505th District Court of Fort Bend County, to vacate his April 13, 2020 order granting the motion to set aside the jury's verdict and for new trial.

Relator has not established that he is entitled to mandamus relief. Accordingly, we deny relator's petition for writ of mandamus.

PER CURIAM Panel consists of Justices Bourliot, Hassan, and Poissant.
