Original Proceeding on Petition for Writ of Mandamus

We deny the petition for a writ of mandamus.

Panel consists of Chief Justice Radack and Justices Alcala and Higley.


MEMORANDUM OPINION


Relator Timothy Paul Martin has filed a petition for a writ of mandamus complaining of Judge Erwin Ernst. Martin, however, has not included with his petition the appendix required by Texas Rule of Appellate Procedure 52.3(j).

The Honorable Erwin Ernst, visiting judge for the 278th District Court of Walker County, Texas. The underlying lawsuit is Martin v. Tex. Dep't Criminal Justice, No. 22,017 (278th Dist. Ct., Walker County, Tex.).
