ORDER MODIFYING OPINION
O'LEARY, J.
Although spelled correctly seven times throughout the opinion, Commissioner Vogl has by letter informed this court that there is one instance of a typographical error in the spelling of his name. It is ordered that the opinion filed on June 14, 2010, be modified as follows: On page 11, second sentence of the first full paragraph of section VI, reads “Vogel” is changed to “Vogl.” This modification does not change the judgment.
