It is ordered that the opinion filed herein on January 31, 2008, be modified to include the following sentence as follows:

On page 19, after the final sentence of the last paragraph of the opinion, add this sentence “In the interest of justice, each party is to bear his or her own costs.”

The modification does effect a change in the judgment. The petition for rehearing is DENIED.
