ORDER

Peter Kelly, Judge.

On the parties' joint motion, the Court abated this appeal so that the parties could engage in settlement negotiations. In the order, the Court directed the parties to advise the Court of the status of negotiations by September 15, 2023. On September 15, 2023, appellee's counsel filed a letter stating that the parties had not reached a settlement. Appellant's counsel failed to file an update.

Accordingly, the abatement is lifted and the appeal is reinstated on the active docket.

Appellee's brief is due within 30 days of the date of this order.

It is so ORDERED.
