On September 1, 2009, (176 Cal.App.4th 387; ___ Cal.Rptr.3d ___ ). this court received respondent's application for "modification of decision." The clerk is directed to file respondent's application which we grant in part and deny in part.

Pursuant to California Rules of Court, rule 8.264(c), it is ordered that the opinion filed herein on August 3, 2009, be modified as follows:

On page 4 [176 Cal.App.4th 392, advance report, 1st full par., line 3], line 2 of the third paragraph beginning "The 1999 stipulated judgment awarded to Park," delete "(2) miscellaneous guns and related paraphernalia, having a value of $45,420" and replace it with "(2) miscellaneous personal property having a value of $45,420."

This modification does not effect a change in the judgment. Respondent's application for modification of decision is otherwise denied.
