On order of the Court, the motions for immediate consideration and for leave to file a brief as amicus curiae are GRANTED. The application for leave to appeal from the February 22, 2001, decision of the Court of Appeals, is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the Court of Appeals order finding respondent Hon. James M. Batzer in contempt. In all of the circumstances of the case, including the judge's effort to seek superintending control from this Court, and thereafter sending the February 9, 2001, letter to the State Court Administrator, Judge Batzer's conduct did not amount to willful disobedience of the Court of Appeals December 8, 2000, order.
