IN THE INTEREST OF L.R.,III AND A.R. CHILDREN

From the 216th Judicial District Court, Kerr County, Texas
Trial Court No. 15759A
Honorable Cathy Morris, Judge Presiding

ORDER

Appellant's court-appointed attorney filed a brief pursuant to Anders v. California, 368 U.S. 738 (1967). In compliance with the procedure set out in Anders, appellant's attorney stated that he sent a letter to appellant, which explained appellant's right to review the record and file a pro se brief. See Kelly v. State, 436 S.W.3d 313 (Tex. Crim. App. 2014); In re R.R., 2003 WL 21157944, at *4. Counsel's letter also advised appellant that if he wishes to review the appellate record, he must file a motion in this court within ten days of receiving counsel's letter. On June 12, 2017, we issued an order directing appellant that if he desired to file a pro se brief, he must do so on or before July 3, 2017.

On June 30, 2017, appellant filed a motion requesting an extension of time to file a pro se brief in which he acknowledged he received counsel's letter on May 30, 2017. On July 3, 2017, appellant filed a motion requesting access to the appellate record. See Kelly v. State, 436 S.W.3d 313, 321 (Tex. Crim. App. 2014). Appellant's motions for extension of time and to access the record are GRANTED. The clerk of this court is instructed to send a paper copy of the clerk's record and reporter's record for this appeal to appellant with this order.

If, after reviewing the record, appellant desires to file a pro se brief, he must do so on or before July 25, 2017. If appellant files a pro se brief, the State may file a responsive brief no later than thirty days after the date the appellant's pro se brief is filed in this court. FURTHER EXTENSIONS OF TIME ARE DISFAVORED.
