Opinion

No. 05-03-01096-CV

Opinion issued July 24, 2003

Original Proceeding from the County Court at Law No. 2 Dallas County, Texas, Trial Court Cause No. 02-09981-B

Writ of Mandamus Denied

Before Justices MORRIS, FITZGERALD, and LANG.

MEMORANDUM OPINION

Relators contend the trial judge erred in denying their motion for leave to file a third party petition. The facts of this original proceeding are known to the parties so we do not recite them here. Based on the record presented, we conclude the relators have failed to show the trial court clearly abused its discretion in denying their motion for leave to file a third party petition. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
