The appellate record in this appeal is due October 3, 2023. Noting appellant filed a statement of inability to afford court costs and the statement has been contested, Official Court Reporter for the 468th Judicial District Court Robin Benton, Deputy Reporter Robyn Rodriguez, and Collin County District Clerk Michael Gould have filed requests for a forty-five day extension of time to file their respective records. The extension would allow for the trial court to rule on the contest, appellant to pay for the record if the contest is sustained, and the record to be prepared. The contest is set for hearing October 12, 2023.
We GRANT the requests TO THE EXTENT we SUSPEND the deadline for the filing of the appellate record and ORDER Mr. Gould to file, no later than October 16, 2023, either a supplemental clerk's record containing a copy of the trial court's written order on the contest or a status report. The Court will set a new deadline for the record upon the filing of the supplemental record.
We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Lindsey Wynne, Presiding Judge of the 468th Judicial District Court; Mr. Gould; Ms. Benton; Ms. Rodriguez; and the parties.
