ORDER

On November 15, 2023, relators Leo Lapuerta, M.D., F.A.C.S., and The Plastic Surgery Institute of Southeast Texas, P.A. filed a petition for a writ of mandamus. In the mandamus petition, relators argue that the trial court abused its discretion by "granting a new trial following a duly deliberated jury verdict," and in doing so, "providing legally invalid reasons for" granting new trial, and by further "failing to state any reasons that the record supports." Relators therefore request that the Court issue a writ of mandamus directing the trial court "to vacate and set aside" the amended new trial order, and to further direct the trial court "to sign a take-nothing Final Judgment in favor of relators.

We request a response to the petition for writ of mandamus from the real party in interest, Jose Torres. The response, if any, is due to be filed with this Court no later than twenty days following the date of this order.

It is so ORDERED.
