On May 3, 2023, relator, Mohamed Laham, filed a petition for a writ of mandamus. In the mandamus petition, Laham argues that the trial court erred by denying his "Motion Requesting Administrative Closure of Case for Lack of Jurisdiction." Laham contends that the trial court lost plenary power over the trial court case on February 27, 2023, which is thirty days after the trial court entered an Order of Partial Dismissal, which included the language: "This Order is final and disposes of all parties and claims."

Laham requests that the Court issue a writ of mandamus directing the trial court to "take no further action in this proceeding as it pertains to [Laham] other than [to] direct[] the Harris County District Clerk to close the case administratively."

In connection with his petition for writ of mandamus, Laham also filed a "Motion for Emergency Stay," requesting that the Court "stay . . . all proceedings in the trial court concerning this matter." Laham argues that the stay is "necessary to maintain the status quo of the parties and preserve the Court's jurisdiction to consider the merits of the original proceeding." Laham's motion for emergency stay is denied.

We further request a response to the petition for writ of mandamus from the real party in interest. The response, if any, is due to be filed with this Court no later than twenty days following the date of this order.
