MEMORANDUM OPINION


On August 19, 2008, relator, Abdel Hakim Labidi, M.D., Ph.D., filed a petition for writ of mandamus in this court. See Tex. Gov't Code Ann. § 22.221 (Vernon 2004); see also Tex. R. App. P. 52. In the petition, relator asks this court to compel the Honorable John Donovan, presiding judge of the 61st District Court of Harris County, to vacate his May 16, 2008 order granting the motion to compel arbitration and stay litigation filed by real parties in interest, Michael D. Sydow; Sydow, McDonald, Kaiser Ahmed; and Mohammed Sameer Ahmed.

Relator has not provided this court with a sworn or certified record. See Tex. R. App. P. 52.7(a). Therefore, relator has not established his entitlement to the extraordinary relief of a writ of mandamus. Accordingly, we deny relator's petition for writ of mandamus without prejudice.
