IN THE INTEREST OF L.A., G.A. III, AND M.E.A., CHILDREN, Appellant.

Appeal from the 65th District Court of El Paso County, Texas (TC# 2023DCM0095)

Before Alley, C.J., Palafox and Soto, JJ.

ORDER

PER CURIAM.

On March 14, 2024 this Court notified Appellant's counsel that the brief was past due, and gave Appellant an additional ten days in which to file both an appellate brief and a motion for extension of time to file the same. As of this date, neither have been received.

Therefore, this case is ABATED and REMANDED to the trial court for a status hearing. Tex.R.App.P. 38.8(a)(2) (permitting an appellate court to remand an appeal for further direction when the appellant fails to file a brief). Due to the time-sensitive nature of an appeal from a parental termination order, the trial court shall use whatever means necessary to appoint new counsel to represent M.H. in this appeal. The appointment shall be made on or before April 5, 20024. The name, address, email address, telephone number, and state bar number of the newly appointed counsel shall be provided in the appointment order of the trial court. The district clerk is ordered to prepare and file a supplemental clerks' record containing the order on or before April 5, 2024.

Newly appointed counsel shall file M.H.'s brief within twenty days from the date of appointment unless the deadline is extended by this Court for good cause.

IT IS SO ORDERED.
