ORDER

PER CURIAM :

AND NOW, this 12th day of March, 2012, Kevin Joseph Kilduff having been suspended from the practice of law before the Internal Revenue Service for a period of forty-eight months by the Decision on Appeal issued on January 20, 2010, by the Office of Chief Counsel of the Internal Revenue Service; the said Kevin Joseph Kilduff having been directed on November 10, 2011, to inform this Court of any claim he has that the imposition of the identical or comparable discipline in this Commonwealth would be unwarranted and the reasons therefor; and upon consideration of the responses filed, this Court declines to impose reciprocal discipline and it is hereby

ORDERED that Kevin Joseph Kilduff be subjected to public censure by this Court.

Mr. Justice McCaffery dissents.
