MEMORANDUM OPINION


On December 16, 2008, we notified appellant Wright Wiley Singleton that the fee for the clerk's record in this case had not been paid and that if appellant failed to pay the fee within ten days, the appeal would be dismissed. To date, appellant has not paid the fee or otherwise communicated with the Court regarding this appeal. Accordingly, we DISMISS this appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).
