MEMORANDUM OPINION


Relator James Kearney has filed a petition for writ of mandamus complaining about the trial court's order that severed a third party from the underlying lawsuit. We deny the petition for writ of mandamus and all outstanding motions.

The underlying lawsuit is In the Matter of the Marriage of James I. Kearney and Mimi H. Tran, Cause no. 2002-58975, in the 257th Judicial District Court of Harris County, Texas.
