No. 05-03-01091-CV (Tex. App. Jul. 22, 2003)

Opinion

No. 05-03-01091-CV.

Opinion issued July 22, 2003.

Denied.

Before Justices MORRIS, FITZGERALD, and LANG.

MEMORANDUM OPINION

Relator contends Bruce Sherbert, elections administrator of Dallas County, Texas, will abuse his discretion or violate a ministerial duty by certifying to the Dallas County Commissioner's Court the number of signatures on petitions for a local option election for Duncanville, Texas. The facts of this original proceeding are known to the parties so we do not recite them here. Based on the record presented, we conclude the relator has not shown herself entitled to the relief requested from this Court. Accordingly, we DENY relator's request for emergency relief and petition for writ of mandamus. See Tex.R.App.P. 52.8(a).
