Order to show cause issued, returnable in Superior Court

The Secretary of the Department of Corrections and Rehabilitation is ordered to show cause before the Los Angeles County Superior Court, when the matter is ordered on calendar, why relief should not be granted on the ground that petitioner is entitled to a fitness hearing under Welfare and Institutions Code section 707, subdivision (a), as conceded by the Attorney General in his informal response filed August 6, 2019. The contention that petitioner is entitled to a hearing under People v. Franklin (2016) 63 Cal.4th 261 is denied without prejudice to a motion made in the Los Angeles County Superior Court pursuant to Penal Code section 1203.01. (See In re Cook (2019) 7 Cal.5th 439.) The return must be served and filed on or before December 2, 2019.
