Appellant, J.A.F., a juvenile, has appealed from the trial court's November 8, 2023 "Dispositional Order of Transfer to the Institutional Division of the Texas Department of Criminal Justice." On January 29, 2024, counsel for J.A.F. filed a "Motion to Transfer Appeal to the Fourteenth Court of Appeals Pursuant to Local Rule 1.5."
In the motion, counsel for appellant states that he filed a notice of appeal on behalf of appellant in three separate trial court cases. Two of those notices of appeal were assigned to the First Court of Appeals: case number 01-23-00912-CV, corresponding to trial court case number 2021-01503J, and case number 01-23-00913-CV, corresponding to trial court case number 2021-01501J. One was assigned to the Fourteenth Court of Appeals-appellate case number 14-23-00922-CV, corresponding to trial court case number 2021-01500J.
Appellant's motion requests that appellate case number 01-23-00912-CV "be transferred to the Clerk, Fourteenth Court, and that the transferee court docket this appeal and assign a new appellate case number." Local Rule 1.5 permits the transfer of cases between the First and Fourteenth Courts of Appeals "when a related appeal . . . has been previously filed." 1st Tex.App. Loc. R. 1.5(a). Local Rule 1.1 defines a "related" case as a case "arising from the same underlying case." 1st Tex.App. Loc. R. 1.1(b).
As noted above, the Court's records reflect that each appellate case number arises out of a different underlying trial court case number. Accordingly, Local Rule 1.5 does not permit this Court to transfer this case to the Fourteenth Court of Appeals.
Appellant's motion to transfer is therefore denied.
