Estate of J. W. Boles, Deceased

Probate Court of Galveston County No. PR-0080741

ORDER

The Court abated this appeal and remanded to the trial court to correct its order on appellant's ability to afford payment of costs on appeal and include language advising appellant that she could appeal the order by filing a motion within 10 days of the date of the trial court's order. See Tex. R. Civ. P. 145(f)(4). The trial court filed a supplemental clerk's record containing the modified order. Appellant did not challenge this modified order. Therefore, she is responsible for payment of costs for the record and filing fees.

The abatement is lifted and the appeal is reinstated on the active docket.

Appellant has not made financial arrangements for the preparation and filing of the clerk's record. The appeal may be dismissed unless appellant provides proof to this Court within 30 days from the date of this order that she has made financial arrangements for the filing of the clerk's record. See Tex. R. App. P. 35.3(c), 42.3.

It is so ORDERED.
