On Appeal from the 366th Judicial District Court, Collin County, Texas, Trial Court Cause No. 366-70121-02

DISMISSED

Before Justices JAMES, FRANCIS, and LANG

MEMORANDUM OPINION

By the Court's order of June 16, 2003, this appeal was abated to allow the trial court to conduct a hearing to determine whether or not appellant, a juvenile, and his parent or guardian desire to pursue this appeal. Before the Court is appellant's June 30, 2003 motion to withdraw notice of appeal, wherein appellant states ". . . that this decision has been made freely and voluntarily, and only after its consequences have been fully explained by appellate counsel. This is a personal decision on the part of the appellant. There has been no undue influence or coercion involved in appellant's decision to withdraw the appeal." Appellant's motion to withdraw is signed by appellant, appellant's mother, and appellant's counsel. We REINSTATE this appeal.

In addition to requesting permission to withdraw this appeal, appellant also asks that the Count "send a mandate to the 366th Judicial District Court of Collin County, Texas reflecting that the appeal has been dismissed." Appellant's motion is GRANTED, and this appeal is DISMISSED. See Tex.R.App.P. 42.1(a)(1). The Clerk of the Court is DIRECTED to issue mandate in this case as of the date of this opinion.
