Opinion

No. 80-K-2917.

February 20, 1981.

In Re: State of Louisiana, through the District Attorney W. Gregory Arnette, applying for writs of certiorari, prohibition and mandamus, Parish of Jefferson Davis.

Denied.

LEMMON, J., concurs. The trial judge properly refused to accept language which exceeded that within the grand jury's power to act. C.Cr.P. 444.

DIXON, C. J., agrees with the concurrence of LEMMON, J.

WATSON, J., would grant the writ, being of the opinion that the grand jury could return a report of simply "no true bill."
