IN RE HOWARD HOLLAND, Relator

Original Proceeding from the 422nd Judicial District Court Kaufman County, Texas Trial Court Cause No. 29317D-422

Before Justices Reichek, Smith, and Kennedy

MEMORANDUM OPINION

NANCY KENNEDY, JUSTICE

Before the Court is relator's June 27, 2023 petition wherein he asks the Court to compel the trial court to rule on an application for a writ of habeas corpus that he contends he filed in May 2022.

Relator's petition does not comply with the Texas Rules of Appellate Procedure because it is not supported by a sworn or certified record. See TEX. R. APP. P. 52.3(K)(1)(A), 52.7(A)(1); see also In re Holland, No. 05-23-00342-CV, 2023 WL 3335565, at *1 (Tex. App.-Dallas May 10, 2023, orig. proceeding) (mem. op.).

Accordingly, because relator's petition does not meet the requirements of the Texas Rules of Appellate Procedure for consideration of mandamus relief, we deny relator's petition. See Holland, 2023 WL 3335565, at *1; see also In re Jones, No. 05-23-00492-CV, No. 05-23-00493-CV, 2023 WL 4101440, at *1 (Tex. App.- Dallas June 21, 2023, orig. proceeding) (mem. op.).
