On order of the Court, the motion for immediate consideration and the application for leave to appeal from the November 1, 2002 decision of the Court of Appeals are considered. Immediate consideration is GRANTED. Pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted. We ORDER the Court of Appeals to expedite its consideration of this case. We further ORDER that the trial in the Family Division of the Oakland Circuit Court be stayed, except that, on motion of a party or on its own motion, the Family Division of the Oakland Circuit Court may act to protect the safety of the children or conduct proceedings required by law.
