Opinion

No. 05-07-00460-CV

Opinion issued August 28, 2007.

Original Proceeding from the 195th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F91-33460-N.

Before Justices WHITTINGTON, LANG, and MAZZANT.

Opinion by Justice LANG.

MEMORANDUM OPINION

We REINSTATE this original proceeding. Relator filed a pro se petition for writ of mandamus complaining that the trial judge, who is no longer in office, failed to rule on his Motion for Post Conviction Forensic DNA Analysis filed by his counsel on September 20, 2005. The newly elected trial judge has ruled on relator's motion. Accordingly, we DENY the petition for mandamus as moot. See Tex. R. App. P. 52.8.
