ORDER
Before the court is the appeal by Melvin Ray Hassell from a decision of the bankruptcy court lifting an automatic stay, pursuant to 11 U.S.C. § 362(d), in favor of the United States to allow it to collect the tax debt owed by Melvin and Nelda Hassell to the Internal Revenue Service. On July 26, 2004, the bankruptcy court dismissed case No. 02-37307-HDH-7. See Order Dismissing Case with One Year Injunction Against Refiling, Bankr. No. 02-37307 (filed Jul. 26, 2004). Due to the dismissal of the underlying bankruptcy case, the appeal pertaining to the automatic stay is DENIED as moot.
