Opinion

No. 05-09-00889-CV

Opinion issued August 5, 2009.

Original Proceeding from the 354th Judicial District Court, Hunt County, Texas, Trial Court Cause No. 69,778.

Before Justices MOSELEY, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relators contend the trial judge erred in granting real party in interest's Motion to Exclude Certain Testimony of Defense Expert Witness, Richard Schlueter, and in denying relators' motion for reconsideration of that order. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 837 (Tex. 1992). Accordingly, we DENY relators' petition for writ of mandamus.
