No. 05-03-00887-CV (Tex. App. Jun. 23, 2003)

Opinion

No. 05-03-00887-CV.

Opinion issued June 23, 2003.

Original Proceeding from the 401st Judicial District Court, Collin County, Texas, Trial Court Cause No. 401-825-00.

Writ of Mandamus Denied.

Before Chief Justice THOMAS, AND Justices MOSELEY and BRIDGES.

MEMORANDUM OPINION

Relator contends the trial judge erred in not declaring two candidates for a zoning committee election as having been properly nominated and elected. The facts of this original proceeding are known to the parties so we do not recite them here. Based on the record presented, we conclude the relators have not shown the trial court clearly abused its discretion in not declaring the two candidates for the zoning committee election as having been properly nominated and elected. Accordingly, we DENY relators' motion for emergency relief and petition for writ of mandamus. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
