ORDER

¶ 1 Department II of the Court, composed of Chief Justice Madsen and Justices Chambers, Fairhurst, Stephens and Gonzalez, considered this matter at its June 5, 2012, Motion Calendar and unanimously agreed that the following order be entered.

¶ 2 IT IS ORDERED:

¶ 3 That the Petitioner's Motion for Discretionary Review is granted and the matter is remanded to the Court of Appeals Division Two for reconsideration in light of In re Personal Restraint of Eastmond, 173 Wash.2d 632, 272 P.3d 188 (2012) and In re Personal Restraint of Scott, 173 Wash.2d 911, 271 P.3d 218 (2012).
