Opinion

No. 01-03-00004-CV.

Opinion issued March 13, 2003.

Original Proceeding on Petition for Writ of Mandamus.

Panel consists of Justices HEDGES, JENNINGS, and ALCALA.

MEMORANDUM OPINION

Relator has filed petitions for writ of mandamus, prohibition, and injunction complaining of (1) Judge Frank Carmona's July 24, 1998 order declaring relator to be a vexatious litigant and (2) Judge Sonny James's December 8, 1997 writ of possession.

The Honorable Frank Carmona, former judge of the 212th District Court of Galveston County, Texas. The underlying lawsuit is Gordon v. Tex. First Bank-Tex. City, No. 97-CV-1156 (212th Dist. Ct., Galveston County, Tex.).

The Honorable Sonny James, justice of the peace, precinct 3, Galveston County, Texas. The underlying lawsuit is Tex. First Bank-Tex. City v. Gordon, No. JC00006248 (Justice of the Peace Ct., Precinct. No. 3, Galveston County, Tex.).

Judge Carmona is no longer the judge of the 334th District. The proceeding against him is, therefore, moot. See generally State v. Olsen, 360 S.W.2d 402, 403 (Tex. 1962). Furthermore, we have no general writ power over a justice of the peace. See Tex. Gov't Code Ann. § 22.221(b) (Vernon Supp. 2003); Easton v. Franks, 842 S.W.2d 772, 773-74 (Tex.App.-Houston [1st Dist.] 1992, no writ).

Relator mentions the Honorable Susan Criss, judge of the 212th District Court of Galveston County, Texas, but does not complain about any specific orders she signed.

We dismiss the petitions for writ of mandamus, prohibition, and injunction.
