IN RE Abelardo G. GONZALEZ

MEMORANDUM OPINION

Original Mandamus Proceeding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Rebeca C. Martinez, Justice Irene Rios, Justice PETITION FOR WRIT OF MANDAMUS DISMISSED

This proceeding arises out of Cause No. 2008CRR-000657-D1, styled State of Texas v. Abelardo Gonzalez, pending in the 49th Judicial District Court, Webb County, Texas, the Honorable Philip A. Kazen, Jr. presiding.

On April 26, 2017, Relator filed a petition for writ of mandamus complaining the trial court had refused to rule on several motions. This court abated this mandamus proceeding twice to allow the newly appointed trial judge time to consider the motions in question. The trial court has now ruled on all pending motions. On September 5, 2017, Relator filed a "Motion to Compel for Ruling and Motion to Dismiss," requesting this court dismiss this proceeding after first ruling on a motion for sanctions filed by Relator on August 23, 2017.

This court has considered Relator's motion for sanctions and has concluded sanctions are not merited. Accordingly, this court denies Relator's motion for sanctions and grants Relator's motion to dismiss this proceeding.
