Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Gilberto Gonzales, has filed a petition for writ of mandamus, asking this Court to vacate the trial court's order that denied his no evidence motion for summary judgment and motion to strike and to enter an order that the responsibility of a designated unknown responsible third party shall not be submitted to the jury.

The underlying case is Gilberto Gonzales v. Houston Distributing Company, Inc. and Ronnell Belizeard, cause number 2017-33373, pending in the 190th District Court of Harris County, Texas, the Honorable Beau A. Miller presiding.

We deny relator's petition for writ of mandamus. See TEX. R. APP. P. 52.8(a). We dismiss all other pending motions as moot.
