Opinion

No. 05-06-00141-CV

Opinion issued February 17, 2006.

Original Proceeding from the County Court at Law No. 5, Dallas County, Texas, Trial Court Cause No. cc-02-02236-e.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relators contend the trial judge abused his discretion in denying their motion to allow for destructive testing of human tissue in a suit alleging fatal exposure to asbestos. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relators have failed to show the trial judge clearly abused his discretion. See Tex.R.App.P. 52.8(a). Accordingly, we DENY relators' petition for writ of mandamus.
