ON APPLICATION FOR A WRIT OF MANDAMUS TRIAL CAUSE NO. 1758852 IN THE 339TH DISTRICT COURT FROM HARRIS COUNTY

ORDER

PER CURIAM.

Relator, through counsel Jani Maselli Wood and Nicholas Mensch (Harris County Public Defenders), is challenging the decision of the First Court of Appeals to conditionally grant the State's petition to vacate the orders of the 339th District Court of Harris County that required the State to return to Relator property belonging to him. The First Court of Appeals issued a published opinion. See In re State of Texas ex rel. Kim Ogg, No. 01-22-00157-CR (Tex. App.-Houston [1st Dist.] del. Oct. 4, 2022). Relator asks for a temporary stay of the proceedings in the district court, and he asks that this Court uphold the district court's orders requiring the State to return Relator's property to him.

The State of Texas, through the Harris County Criminal District Attorney, is a Real Party in Interest and may provide a response. Any response shall be filed with this Court within thirty (30) days of the date of this order. The proceedings in the district court are stayed pending this Court's resolution of this matter.
