Re: ADOPTION OF the Resolution of the Court of Appeals of Indiana in Memory of the Late William I. GARRARD


ORDER

The Court orders the foregoing Memorial Resolution spread of record upon the permanent records of this Court, and the Clerk of this Court is ordered to deliver a copy of said Memorial Resolution to West Publishing Company, which is ordered to print and publish the same in the North Eastern Reporter.

IT IS FURTHER ORDERED that the Clerk of this Court transmit a copy of said Memorial Resolution, under seal of this Court, to Linda L. Chezem, 530 Denny Drive Mooresville, IN 46158.

So ORDERED in Indianapolis, Indiana, on 6/13/2023.

IN MEMORIAM

HONORABLE WILLIAM I. GARRARD

The following resolution was adopted as a memorial to the late William I. Garrard.

WHEREAS, William I. Garrard, a resident of Mooresville, Indiana, was a Judge of the Court of Appeals of Indiana; and

WHEREAS, it is with deep regret that we note the passing of Judge Garrard at age 91 on June 2, 2023 2023; and

WHEREAS, Judge Garrard was appointed to the Court of Appeals in 1974 by Governor Otis Bowen and was retained by election in 1986 and 1996. He served as presiding judge of the Third District for three terms and served more than 26 years on the bench, retiring on January 24, 2000 and serving as a Senior Judge from January 24, 2000 to December 31, 2016; and

WHEREAS, Judge Garrard was born in Indianapolis on October 16, 1932 and raised in Frankfort, Indiana, graduating from Frankfort High School in 1950. He was an Eagle Scout and graduate of Wabash College who served as an enlisted soldier in the U.S. Army before enrolling at the Indiana University School of Law in Bloomington, where he was elected to the Order of the Coif and graduated in 1959 with distinction; and

WHEREAS, Judge Garrard began his legal career with the Warsaw, Indiana, firm Graham, Rasor, Eschbach & Harris and practiced law with the firm for the next 15 years, also serving as Deputy Prosecutor from 1959 to 1969; and

WHEREAS, Judge Garrard earned his L.L.M. in 1990 from the University of Virginia Law School, becoming the first Indiana judge to attend the school's master's degree program for sitting judges; and

WHEREAS, Judge Garrard served as an adjunct professor at the IU School of Law, Bloomington, for 10 years and is a past president of the law school's Alumni Association. He is also a recipient of Wabash College's David Peck Medal, three Sagamore of the Wabash awards (given by Governors Otis Bowen, Evan Bayh, and Frank O'Bannon,) and the Indiana State Bar Association's Presidential Citation. He was inducted into the Indiana University School of Law Academy of Law Alumni Fellows in 2000; and

WHEREAS, Judge Garrard served as president of the Kosciusko County Bar Association; vice chairman and parliamentarian of the Indiana Supreme Court Rules Committee; and secretary of the Indiana State Bar Association. He also served as president of the Warsaw Rotary Club; president of the Warsaw Chamber of Commerce; founding director of the Kosciusko Community YMCA; elder and president of the board of trustees of the First Presbyterian Church of Warsaw; and president of the Kosko Conservation Club. He is also a past president of the Indiana University School of Law. Bloomington Law Alumni Association. He was inducted into the Academy of Law Alumni Fellows (2000); and

WHEREAS, Judge Garrard is survived by his wife, Linda L. Chezem and his children, Michael Garrard, Kathleen West, Kelly Smith, and a daughter of the heart, Sally Ann Wood, and his nine grandchildren and six great grandchildren; and

WHEREAS, Judge Garrard's passing is a loss to his community, our State, his family and friends, and this Court.

NOW, THEREFORE, BE IT RESOLVED, that this Memorial Resolution for the Honorable William I. Garrard be adopted by the Court of Appeals of Indiana and spread of record on the Order Book of this Court.

BE IT FURTHER RESOLVED, that the members of this Court extend their sympathy to the family and friends of this able lawyer and jurist and that a copy of the Memorial Resolution, under seal of this Court, be sent to his wife, Linda L. Chezem.
