Opinion

No. 05-09-00322-CV

Opinion issued April 6, 2009.

Original Proceeding from the 282nd Judicial District Court Dallas County, Texas, Trial Court Cause No. F0155810.

Before Justices MOSELEY, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relator contends the trial judge erred in including an affirmative finding that a deadly weapon had been used or exhibited during the commission of the offense in his conviction for unlawful possession of a firearm. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 837 (Tex. 1992). Accordingly, we DENY relator's petition for writ of mandamus.
