ORDER


This matter is before the Court on the Motion of the Debtor, Rondal R. Francis, to waive his attendance at the 341 meeting of creditors and conduct his examination by interrogatories due to his present incarceration. Attached to the motion is an Affidavit regarding the Debtor's inability to attend the 341 meeting and proposed Answers to Interrogatories, neither of which is signed by the Debtor.

We adopt and incorporate by reference the attached recent opinion written by Judge John C. Ninfo, II. In re Sochia, 231 B.R. 158 (Bankr.W.D.N.Y. 1999). Pursuant to the reasoning of the Sochia case, and the Court being otherwise sufficiently advised,

IT IS ORDERED that this case be dismissed, for cause pursuant to 11 U.S.C. § 707(a), based on the Debtor's failure to attend the meeting of creditors.
