Opinion

No. 84-1126.

March 13, 1985.

Appeal and Cross Appeal from Circuit Court, Palm Beach County; Marvin U. Mounts, Jr., Judge.

Moria Rozenson of Brown Pickett, West Palm Beach, for appellant.

Glenn H. Mitchell, of Mitchell, Hanser Schwartz, West Palm Beach, for appellee.

There was substantial competent evidence upon which the trial court could conclude that appellee was the innocent owner of the Porsche Targa involved here; therefore we affirm, albeit for a different reason or theory from that recited by the trial court, which nevertheless properly denied forfeiture of the vehicle.

LETTS, GLICKSTEIN and DELL, JJ., concur.
