The attorney for appellee, Dixie Lucille Black Baker, has filed a motion to dismiss the appeal in this cause and upon consideration, it is

Ordered that the said motion be and the same is hereby granted and the appeal in this cause commenced by notice of appeal filed in the County Judge's Court for Pinellas County, Florida, on August 19, 1960, be and the same is hereby dismissed for the reason that the Order appealed is not a final order, judgment or decree within the meaning of Article V, § 5(3) Constitution of Florida, F.S.A.
