AN ORIGINAL PROCEEDING IN MANDAMUS

Before Rodriguez, C.J., Palafox, and Alley, JJ.

MEMORANDUM OPINION

JEFF ALLEY, JUSTICE

Relator, Jose Esquivel, and real party in interest, Ernesto Valtierra, have filed a joint motion to dismiss this petition for writ of mandamus. See Tex.R.App.P. 42.1(a) (governing voluntary dismissals). Real Party in Interest has also filed in this Court a notice of settlement, indicating that the dispute underlying this original proceeding has been settled. Further, the parties indicate in their joint dismissal motion that a notice of nonsuit has been filed in the trial court.

We grant the parties' joint motion and dismiss this original proceeding. See Tex.R.App.P. 42.1(a). Accordingly, we lift our August 24, 2022, stay order. Court costs are taxed against Relator. See Tex.R.App.P. 42.1(d) (court to tax costs against appellant absent agreement of the parties).
