Summary of Misconduct:

Mr. Ervin, who was licensed in 1983, was suspended for two years and until further order of the Court. He neglected several matters for a client, failed to return unearned fees and did not cooperate in the disciplinary proceeding. He has been suspended since September 27, 2004, for unrelated misconduct.

Order of the Court:

The motion by the Administrator of the Attorney Registration and Disciplinary Commission to approve and confirm the report and recommendation of the Hearing Board is allowed, and respondent Burgess Francis Ervin is suspended from the practice of law for two years and until further order of the Court.
