[PROPOSED] ORDER CLARIFYING THE COURT'S MARCH 1, 2005 ORDER CONCERNING THE TIME FOR FILING THIRD-PARTY COMPLAINTS AND CROSS-CLAIMS IN NEWBY


Upon consideration of the Bank Defendants' Unopposed Motion To Clarify The Court's March 1, 2005 Order Concerning The Time For Filing Third-Party Complaints And Cross-Claims In Newby ("Motion"), it is hereby:

ORDERED that the Motion is GRANTED; and it is

FURTHER ORDERED that, in the Newby action, third-party complaints and cross-claims must be filed by the later of April 11, 2005 or thirty days after a party files its answer.
