ORDER AMENDING AND CLARIFYING DESIGNATION


In the Court's recent memorandum and order (#1714 in Newby), concluding that it has "related to" bankruptcy jurisdiction over G-02-299, G-02-463, and G-02-723, the Court designated all three actions as "coordinated cases" since they do not allege the same causes of action as Newby. It has come to the attention of the Court that before it developed the "coordinated case" category because of the many cases sent here by the MDL Panel that overlapped in discovery needs, but did not assert the same causes of action as any of the three class actions, this Court had consolidated G-02-299 with Newby pursuant to Judge Rosenthal's original order. Accordingly, the Court hereby amends its original order of consolidation and

ORDERS that G-02-299 shall no longer be consolidated into Newby, but shall proceed as a coordinated case.
