ORDER SUSTAINING DISBURSING AGENT'S OBJECTION TO PROOFS OF CLAIM NOS. 4934, 4988, 5007 AND 5010 FILED BY CERTAIN TAXING AUTHORITIES (DOCKET #3375)
On this day, the Court considered the Disbursing Agent's Objection to Proofs of Claim Nos. 4934, 4988, 5007 and 5010 Filed by Certain Taxing Authorities (Docket #3375) (the "Objection"). The Court, after reviewing the Objection, considering the arguments of counsel and considering the evidence, finds that the Objection has been properly served pursuant to the Federal and Local Rules of Bankruptcy Procedure, that the Court has jurisdiction of this matter, and that the Objection is well taken and should be sustained.
IT IS, THEREFORE, ORDERED, ADJUDGED, and DECREED, that the Objection is SUSTAINED, and proofs of claim numbers 4934, 5007 and 5010 filed by the Kentucky Revenue Cabinet and the Alameda County Tax Collector, respectively, are denied in their entirety. And it is further
ORDERED that neither the Kentucky Revenue Cabinet nor the Alameda County Tax Collector shall be allowed a claim in any amount in any of the Debtors' bankruptcy cases.
